Walton Keeps Adding Businesses. Why Can't It Add Houses?

"The only thing that is being allowed currently are one-offs," Walton Mayor Terri Courtney told the Boone County Planning Commission this month, as reported by LINK nky. "In other words, if you own a plot of land in Walton, it would be considered (if) it would be one residential home, but not a development."

A new Lowe's is about to open on Towne Center Drive. Duke Energy just chose an industrial park off Old Lexington Pike for its economic development program. Inside the city's sewer service area, though, new subdivisions have been on hold since July 2024. Demand isn't the problem. The cause is a small city-run sewer system, treated at a plant on Stephenson Mill Road, that ran out of room before the town stopped growing.

The rule a Walton lot buyer runs into first

In July 2024, Walton City Council voted for a moratorium on new construction in the Walton water and sewer service area. It took effect immediately so the city could add capacity. Councilmember Dan Martin told LINK nky at the time, "Growth is happening so quickly, that right now our water and sewer can't keep up. We want to grow."

The rules have shifted since then, and that history confuses people. In November 2025, City Administrator John Wainwright said the city was "lifting some restrictions on single-family homes and small businesses," and LINK nky's headline said the moratorium had been lifted. That same story noted that projects still needed approval from the Boone County Planning Commission before the city would sign off. By October 2026, the mayor was calling the moratorium "well documented." Her description is the current one: a single house on a lot you already own can be considered, but a development can't.

So a buyer who sees acreage with a Walton address and plans to subdivide it, or who expects a builder to break ground on a new phase soon, should know about this rule before making an offer. A buyer who wants to build one custom home on one lot is dealing with a different set of rules.

The moratorium covers the city's water and sewer service area. That is not the same as every 41094 mailing address. Boone County's comprehensive plan names three public sewer systems in the developed eastern part of the county: Sanitation District No. 1, the City of Florence, and the City of Walton. Much of southern and western Boone County uses septic systems or small private package plants. Which provider serves a particular parcel is something to confirm with the city before you buy, not something to guess from the address.

A 33-mile system in a county run on much bigger pipes

The scale of these systems explains why Walton hit its limit while the rest of the county kept building. The same comprehensive plan lists the length of each public sewer system in Boone County:

Public sewer system Miles of line Treatment
Sanitation District No. 1 1,682.15 Western Regional facility near Belleview, about 20 million gallons per day of capacity
City of Florence 269.28 Part of the eastern county network
City of Walton 33.4 City-run plant on Stephenson Mill Road

SD1's Western Regional plant treats about 8 million gallons a day on average and serves more than 26,650 accounts. Walton's whole system has roughly 750,000 gallons of capacity, and in September 2025 it was reported to be running at nearly 80% of that, according to LINK nky. In a system that small, one mid-sized subdivision can take a meaningful share of what's left. That's why the city stopped approving developments altogether rather than handling them one at a time.

The planned fix is a holding tank that would add about 200,000 gallons. Mayor Courtney said that would raise Walton's sewer capacity by more than 50%. A second tank is expected "decades from now, as needed."

The timeline has already moved once

Anyone waiting on new construction in Walton needs a realistic end date, and the dates so far have slipped:

  1. July 2024. Council adopts the moratorium.
  2. September 2025. Council hires Dirt Werks AG for $23,760 to clear the tank site. The first tank is expected to go out for bids "next summer," then take about two years to build, at an estimated cost of around $5 million.
  3. November 2025. Some restrictions on single-family homes and small businesses are eased, and the city secures an easement for sewer improvements in the Aosta Valley subdivision.
  4. October 6, 2026. The city's caucus agenda lists "Sewer/Water project updates" and a pump at the Ryan Pump Station.
  5. October 2026. The mayor says the city has held an engineering meeting, is still waiting to hear back from the Kentucky Division of Water, and hopes to bid the expansion in March or April. She estimates completion a year to a year and a half after that.

The 2025 story said "next summer," which read from its September 2025 date means summer 2026, and that window has passed without a bid. The 2026 report gives no year for the March or April target. If that means spring 2027 and it holds, a 12-to-18-month build points to added capacity sometime in 2028, and that still depends on the state review. Anyone planning around new Walton construction should treat that as a hopeful estimate, not a schedule.

Businesses aren't waiting for the sewer

Walton's commercial growth hasn't slowed. According to the NKyTribune, Lowe's of Walton at 12100 Towne Center Drive is set to open in November, with about 95,000 square feet of store space and a 30,000-square-foot garden area. It is the chain's 43rd Kentucky location and its first new store in the state since 2009. The store manager, Travis Caldwell, is a Florence native.

On October 19, LINK nky reported that Inland Industrial Park North, a roughly 50-acre site off Old Lexington Pike, was chosen for Duke Energy's Site Readiness Program. Duke Energy, the engineering firm Bayer Becker, and BE NKY will prepare the site and market it to companies nationwide.

Those jobs help pay for the sewer. Since January 1, 2026, Walton has collected a 2% occupational payroll tax on wages earned for work done inside city limits. That includes people who live outside Walton and people who work for companies headquartered elsewhere, according to Boone County's occupational licensing office. For 2026 it applies to wages up to the $184,500 FICA wage limit and is reported quarterly. The 2025 coverage tied the tax directly to paying for the wastewater project.

The 80 condos that will test the rule

A proposal now in front of the county will show how the moratorium handles real demand. Local developer Tony Berling, working through Walton Land Development Company, has asked to rezone vacant land east of Kroger Drive and Towne Center Drive, between Kohl's and Tractor Supply Co., from commercial two to commercial two/planned development. The concept plan shows 80 two-bedroom condos from Fischer Homes' Gallery line, in 10 buildings, each unit with a covered patio or deck. A Fischer Homes land acquisition manager put the starting price at about $180,000, according to LINK nky.

"There's definitely a need for this kind of housing in Walton," Berling said at the hearing, where several residents also spoke against the plan. The planning commission's zoning change subcommittee was scheduled to take it up October 21, and the full commission is set to issue its decision on November 4.

A favorable vote on November 4 still wouldn't put the units on the sewer. The mayor described the moratorium as the obstacle, and connections will depend on the expansion. So a zoning approval would mostly put the project in line for the new capacity.

What this means if you're shopping in Walton now

Across the wider region, buyers have a bit more room. Northern Kentucky REALTORS' September 2026 report shows a median sale price of $310,000, about flat from September 2025. Active listings were up 14.6% to 1,359, months of inventory rose 13% to 2.6, and average days on market reached 31. Those figures cover the association's 12-county MLS area, not Walton specifically.

Walton's own supply works differently. Inside the city's service area, the choices for the next couple of years are mostly existing homes plus the occasional one-off custom build. Buyers set on new construction will find the pipeline elsewhere in the county. Union approved a 135-unit Drees Homes project off Hathaway Road in July 2026, with 29 townhomes and 106 condominiums. Fischer Homes' proposed Cloverlin expansion beside Ballyshannon, with 687 units, faces its own November 4 zoning recommendation. Our Boone County new construction vs. resale guide explains how those two paths compare.

Before an offer on Walton land or a Walton home, confirm these things:

  • Which sewer provider serves the parcel: the City of Walton, SD1, or a septic system.
  • Whether your plan is one house on one lot, or anything the city would treat as a development.
  • The outcome of the November 4 planning commission decision once it is made, and whether the city has put the tank out to bid.
